Republican Texas Rep. Louie Gohmert and a small group of Republicans filed a lawsuit against Vice President Mike Pence in a long shot attempt to overturn the results from the November presidential election.
The lawsuit, filed in federal court in Texas on Monday aims to change the Senate rules that govern the counting of electoral votes under the Electoral Count Act of 1887.
The rules, the suit argues, unconstitutionally limit the vice president, who presides over the Senate, to exercise his “exclusive authority and sole discretion” to pick which votes to count.
The suit comes just over a week before a scheduled Jan. 6 congressional meeting where the Senate will count state electoral votes and is expected to confirm Biden as the 46th U.S. President.
