Update: Fox News reports Missouri Attorney General Eric Schmitt has moved to dismiss the charges brought by Gardner.

[…] St. Louis Circuit Attorney Kim Gardner announced Monday she would be charging Mark and Patricia McCloskey, the couple who waved guns at a crowd marching in their gated community last month, with felony unlawful use of a weapon.

“It is illegal to wave weapons in a threatening manner — that is unlawful in the city of St. Louis,” Gardner said in a statement. She is recommending a diversion program that could include community service instead of jail.
